By accessing or using The Card Genie ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. These terms form a legally binding agreement between you and THECARDGENIE.COM LTD, a company registered in England & Wales (company number 17299111), trading as The Card Genie.
The Card Genie is an online platform that lets you upload photos and use AI to generate personalised cards, including e-cards (images and videos) and physical printed cards posted in the UK. You can share e-cards via link or email, and order the printed add-on for delivery to a UK address. Some features are free; others require payment.
You must be at least 16 years old to use the Service. If you are under 18, you confirm you have the permission of a parent or guardian, and that a parent or guardian agrees to these terms on your behalf.
You are responsible for keeping your account credentials secure. You must not share your account or let anyone else use it. You are responsible for all activity under your account. Please notify us immediately if you suspect unauthorised access.

Your content: You retain ownership of photos you upload. By uploading, you grant us a limited, non-exclusive licence to process your photos solely for the purpose of generating your cards. We do not use your photos for training AI models or for any purpose other than creating your requested cards.
Your warranties about content you upload.By uploading any photo or other content, you confirm and warrant that: (a) you own it or are otherwise licensed to use it; (b) every identifiable person in it has given you their permission to upload and use their image (and, for anyone under 18, you have a parent or guardian's permission); and (c) it does not infringe anyone else's intellectual property, privacy or other rights, and does not breach our Acceptable Use & Content Policy.
Generated cards: Once generated, your cards are yours to use for personal, non-commercial purposes (sharing with friends and family). You may not resell AI-generated cards.
Our content: The Card Genie name, logo, design, and underlying technology are our property. You may not copy, modify, or distribute them.
Paid features are charged via Stripe. Prices are displayed before you confirm purchase and include applicable VAT. By making a payment, you authorise us to charge your chosen payment method. All prices are in GBP unless stated otherwise.

Cards are generated using third-party AI models. AI output can be unpredictable. We do not guarantee that every generation will meet your expectations. We make reasonable efforts to filter inappropriate outputs, but cannot guarantee perfection. If a generation fails or produces unsuitable results, you may be eligible for a refund under our Refund Policy.
To the maximum extent permitted by UK law:
Nothing in these terms limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.
You agree to indemnify us (and keep us indemnified) against any losses, damages, costs and reasonable legal fees we incur as a result of any third-party claim arising from content you upload or create through the Service, or from your breach of these terms or of our Acceptable Use & Content Policy. This includes claims that your content infringes someone's intellectual property, privacy or other rights, or that you did not have permission to use a person's image. We may, where a claim is made, disclose your identity to the person making the claim.
We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may suspend or modify the Service for maintenance, updates, or reasons beyond our control.
The shareable link to a digital card stays live for a limited time. After expiry the link returns a not-found page and the underlying image and video assets are deleted from our storage. The retention windows are:
If you want a permanent copy, download the card (image or video file) from the share page or take a screenshot before the link expires. Printed cards are physical and are yours to keep regardless of when the digital link expires.
We reserve the right to extend, shorten or change these windows for operational reasons (storage cost, abuse, legal request) on reasonable notice. Records linked to payments are kept for 7 years for UK tax compliance regardless of card-link expiry - see the Privacy Policy for the full breakdown.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these terms. On termination, your right to use the Service ends immediately. Provisions that by their nature should survive (limitation of liability, intellectual property, disputes) will continue to apply.
We may update these terms from time to time. If we make significant changes, we will notify you by email or by a notice on the site. Continued use after changes take effect means you accept the new terms.
If something has gone wrong, please email support@thecardgenie.com and we will try to put it right. We aim to acknowledge complaints within 5 working days and to resolve them within 28 days. If we cannot resolve a complaint between us, you may be entitled to refer it to an alternative dispute resolution (ADR) provider; if you ask, we will tell you whether we agree to use ADR and, where we do, which provider. This does not affect your right to take a claim to court.
We are not responsible for delays or failures caused by events outside our reasonable control, including power, internet or third-party service outages, supplier or delivery failures, strikes, fire, flood, severe weather, epidemic, or government action. If such an event happens, we will let you know and do what we reasonably can to limit the impact; where a delay is substantial, you may cancel an affected order and we will refund any sum paid for it.
Severability. If any part of these terms is found to be invalid or unenforceable, the rest continues to apply.
Assignment. We may transfer our rights and obligations under these terms to another organisation, for example if our business is sold; this will not affect your rights. You may not transfer your rights or obligations to anyone without our written permission.
No waiver. If we do not enforce a right straight away, that does not mean we have given it up.
Entire agreement and third parties. These terms, together with the policies they link to, are the whole agreement between us. They do not create any rights for anyone other than you and us under the Contracts (Rights of Third Parties) Act 1999.
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you retain any mandatory consumer protection rights under local law.
